Should a landlord be able to hold an expectant mother, 8 month’s pregnant, and her husband, to a brand new lease when they, and their toddler, are forced to live in a hotel for weeks on end, due to sewer problems? I am a strong believer in contracts; however, when there is failure of consideration and a potential breach of contract, landlords are wise to avoid unfair circumstances. This week, I have been privileged to help this young family work on a resolution of their lease and potentially find a fresh start!
